Areas of Practice
Civil Litigation
An attorney specializing in civil litigation is also called a “litigator” or a “trial lawyer,” and represent individuals or businesses in non-criminal cases. Lawyers specializing in civil litigation must be willing to assume oppositional roles, embracing contention and controversy. They act as their client’s advocate, obligated to fight diligently to achieve the best possible outcome.
Civil Litigation attorneys often represent their clients across a variety of associated proceedings, including pre-trial hearings, depositions, settlement conferences, as well as mediation and arbitration. The mediation and arbitration processes are geared toward aiding the two parties in reaching a settlement rather than investing the additional time and expense of going to court.
Business Contracts
We draft and negotiate a comprehensive range of business contracts, such as vendor/supplier agreements, service contracts, employment agreements, non-compete/non-solicitation agreement, and much more. Proper contract preparation, the negotiation of its terms and conditions, and the correct implementation of those terms and conditions by the business is paramount for reducing risk and breach of contract claims.
Criminal Defense & Municipal Court Matters
Criminal cases are crimes against society rather than a dispute between individuals or organizations. For example, a person who drives drunk and is pulled over will be charged with a criminal case because they have created a dangerous situation for people in the community, their fellow drivers, by driving while intoxicated. Some examples of criminal cases include arson, aggravated assault, D.U.I’s, selling illegal drugs, kidnapping, sexual crimes & murder. Notice that all of these cases involve a threat to society.
Even though it might seem that murder and arson are much more of a threat to a community or society than crimes such as selling drugs or drunk driving, all of these crimes pose dangers to society to some degree. In a criminal case, the prosecutor, representing society, must prove the defendant’s guilt. The full burden of proof is on the government.
Estate Litigation
Estate litigation cases involve formal legal objections over the distribution of assets and inheritance after someone passes away. These legal objections may result from an estate plan being altered due to undue influence or other disagreements over the way that the estate is being administered. Other examples of Estate Litigation are contested wills, legal guardianship disputes, undue influence, mental capacity issues, disputed among trust beneficiaries, breach of fiduciary duty & inheritance disputes.
